Unless it included breaking a law bad attitude isn't a crime. If the story is true as told I find it just as tacky that two off-duty LEO's found it appropriate to confront f-bomb dropping pot smokers. If it escalated it's because they chose to get involved. Doesn't sound like the joint smokers did anything in the lot to provoke that prior to the kids comment.

I didn't think the attitude they had on the course was the cause, I thought it was due to attitude they gave the Cops in the parking lot. I don't find it "tacky" that they confronted the guys. If smoking/possessing marijuana is illegal in the state this occurred in, then they were well within their right/duty to question the smokers based on the kid's comment.

I understood the attitude part happened in the lot. Still don't think it's the place of an off-duty LEO to investigate something so petty. Especially if it's driven by emotion because family was involved. If they don't say anything nothing happens. They have no idea what could happen, is it worth the risk it takes a violent turn with their child present. I don't think so but honestly I'm not 100% buying the story as written. If I was approached for any reason by off duty cops asking me questions it would be me dialing 911.

Long story short one of the guys gave me "what you a cop or something" and added that smoking pot was legal where they came from, and that I should "mind my own f-ing business" . To avoid any further problems, my grand daughter, and I  left to play by ourselves.

As it turned out the four of us wound up in the parking lot, close to each other at the end of our rounds. My son in law, and his brother who are both policemen showed up to pick up our little girl. Out of the blue my grand daughter tells her dad "those guys were smoking pot and were mean to grand pa". Well, that set off another chain events, and because of a poor attitude on their part, these guys would be spending the night in the local lock up.

Smoking an illegal substance in front of a minor can be probable grounds for arrest and confronting the guardian in that manner in front of a minor can be considered verbal assault.

In short don't piss off a cop (or their relatives), because they can take you in for pretty much anything you do.

Uh no. A badge doesn't allow cops to do whatever they want just because they are pissed and it certainly doesn't extend to their families c'mon. Even if they have a legit reason to issue disorderly citation it's a ticket not a trip to county.

It's called "probable cause".

By the wording of the OP, it sounds like it's illegal where they were playing. If two witnesses said they were doing something illegal, that's enough probable cause for search and ultimately lead to possibly their arrest. Not conviction, but arrest.

We need to read between the lines when someone posts something like this.   Regardless, the guys deserved a day in jail.   That will teach them not to smoke a joint in front of a minor in a golf course.

Possession of less than one oz in NV is a $600 fine with no arrest, you get a ticket and that's it. If the so called offenders didn't live in NV chances are it would have been a first offense. Besides the OP is stating the arrest was due to the situation escalating (attitude) because his family chose to confront the guys in the lot after the kid commented about it. Something would have happened at that point for on duty cops to be called. I think some of this is a semi-fictional account of what actually happened. Much ado about nothing.

In what state is it illegal to have a bad attitude???

If not for the bad attitude Cops will sometimes be more lenient, confiscate the illegal substance and let the offender go. If the offender is belligerent the Cops are less inclined to do so. I didn't think that necessitated explanation.

I think most officers would check into such a thing if it happened, family or not. I don't exactly like your "if they don't say anything nothing happens" line. That's a very dangerous way of thinking, in my opinion. Who knows how much they smoked or if they would have been impaired when it came time to drive? I'm pretty anti-drug though, so I'm a bit stubborn on these subjects anyway.

The problem I see with not addressing it after the kid brought it up is you are basically saying, "It's ok they broke the law and that you saw them do it" to the kid.

Purely in the context of the situation escalating in the lot, never mentioned driving. If that was a concern you call 911 and report it, even if you are off-duty. The OP doesn't even mention if the off-duty cops are in their own jurisdiction.

An older guy and his kid were playing with us this weekend and the old guy asked if I minded if he smoked weed. Told him to go ahead and to just stay downwind of me. I don't smoke myself, even cigarettes (especially? I hate the smoke of that more). Wouldn't ask anyone not to smoke around me. We're outside and a decently considerate person can take enough care to avoid having the smoke stay away from the other people.

Well golf courses sell alcohol and you can drink that on the course. You can buy a couple of beers, a couple of drinks, take them out to your cart, and get your blood alcohol level up there on the back nine if you want.

In some states, like where I live, weed is legal. But smoking it in public is not. Also drinking in public isn't. So technically drinking on the golf course isn't drinking in public so is smoking on the golf course smoking in public? Grey area.

I think the problem was the attitude.

As for the parking lot. I'm skeptical.

The problem I see with them addressing it is we have no idea if they legally could question it. Dad being a cop isn't free reign to investigate every bad thing the kid encounters.

Interesting. I agree we don't know everything there is to know here, but a kid saying it with the corroboration of an adult is enough to warrant it in my eyes.
