need help with info on selling a gun!

2 years ago I bought a 30.06 I bought it from walmart and they did a background check or something....how would I go about selling this gun? I dont use it and want to sell it but dont know if I can just sell it or if there is more stuff I have to go thru?

I think my name is on the serial number???

You can just sell it. At least, in the state I live in you can. I don't know about your state.

You can get a bill of sale (online or at Office Depot) and have the buyer sign it if you're apprehensive about the gun being "in your name". But you can simply sell the thing for meatballs if you want to.

This is what i know, and mind you, this is all Colorado law, so it may be different in your state. Your best bet would be to ask a local gunsmith, not some idiot working at a sports store about local laws.

here, -when you purchase a gun, it is registered to you, and then the paper proving it was registered is destroyed, meaning there isnt anything proving the gun is yours per se. - if i arrange on say craigslist to sell a rifle, we may meet in a parking lot, and all i need is too see a drivers lisence to verify that the buyer is 18, other than that, no other verification is needed. again, thats all for CO, so check your local laws, as im sure they vary from state to state.

Just an FYI, but the background check does not "register" the gun to your name, is simply proves that you are legally allowed to purchase and own a gun. The NRA spends millions of dollars every year to ensure there is not a federal gun registration requirement.

A friend of mine sold his gun to someone else and used a shooting range/gunshop as a go-between. I don't know if this did anything more than give the guy peace of mind. Maybe he did it because the peson he sold it to lived in Missouri, not Kansas. But the gun shop/range is in Kansas.

I'd be very inclined to get a concrete answer from a legal authority in your state/locality before doing this. It strikes me as the sort of thing that could potentially turn into a nightmare situation if there turns out to be red tape that was not followed, so I'd go for something more reliable than a golf message board.

I thought maybe someone might have gone through this experience before, which is why I'm asking here. Someone on here may be a maryland cop? or knows the gun laws for a fact? It is possible to get information from a "golf message board"

Oh sure, I don't mean to imply you shouldn't have asked. I'm glad you did; while I don't have or plan on acquiring any guns in the near future, I found the responses interesting. I guess what I meant to suggest was to regard the info you learn here as a jumping off point for asking the right person the right questions locally to confirm the information.

Be thankful you don't live in Canada!! The gun control fanatics won the debate here and it's endless paperwork and background checks... Some gov't paper-pusher analyzes your marital status and history amongst other things. No freedom here

Selling between states can be an issue, as a matter of fact, no individual who has a legal resident outside Kansas can purchase a handgun in Kansas. Long guns are a different story, which might have been why they used someone with a FFL. It would be best to go to a local gun dealer or pawn shop, someone with a Federal Firearms License in your state, for specifc details on how to sell your gun.

1) You CANNOT ship a firearm over state lines to another person directly. You MUST send it to a Federal Firearms License holder. Any legitimate gun store has an FFL. Most will handle the transfer for a small fee ($20 at my local place).

2) you can sell the firearm to anyone you want, provided they are legally allowed to purchase and own firearms. How do you know if they are ok? That's on you. But if you sell it to a convicted crack fiend and he goes and shoots someone with your gun, and that gun gets traced back to you, you could wind up in big time trouble. Generally speaking, you'll be ok. But if the local authorities have a bee in their bonnet then they'll make trouble for you. Or if there was some kind of recent high-profile gun violence in the media and everyone is freaking out about stuff then you might have an issue. It's not hard for them to find SOME law that you broke by not checking out the person before hand even though you'd probably beat it in court because private transfers are completely legit. But do you want to spend the time and money on lawyers?

So the way around THAT is to find a local gunshop as mentioned in #1 above, who will handle a private transfer for you. They'll do the background check and fill out the forms for a fee. They may want a % of the purchase price since most gun stores sell on consignment already and don't want to lose out on any $.

Frankly, I think it's easier just sell it out of state via an FFL. Check out a site called gunbroker, it's like the ebay for guns.
