Sure, What if the guy on the left rotates the clubface really fast, so this means he can have an open clubfact at impact, and end up in the picture above, he would hit a fade. The guy above could have a slower rotation, but hit a draw.

Look at one static point, doesn't mean anything, its how the club got there that matters, and what the clubface is doing at impact.

Both can produce the same.

For the first question, just click "Golf Terminology" in my signature, because both of the swings could have been ON, IN, or OUT - we don't really know. This one picture isn't enough of a clue.
