so I guess he was standing 60-80 degrees to the side and 20 feet ahead. Thats an awfully bad shot to hit him, lol, but it happens. Cant really sue someone IMO, thats why the guy has insurance and he put himself at risk by being on the golf course and standing in the way, sort of.

Hilarious. If you need to shout "fore" BEFORE hitting the ball in order to protect someone 50 degrees to the side, you would surely be such a rotten golfer as to be a danger to all fellow players - and your friends ought to know better than to play with you without helmets.

OTOH, it you shank the ball and your friend is 20 ft away, by the time you shout "fore" the poor sucker is already layed out flat on the grass in agony.

Risk of the game. Case dismissed. All costs awarded to defendant. NEXT.

I was playing 2 weeks ago, walked ahead of one of my 3 ball, he was in center of fairway about 100y short of the green. I walked up to my ball in the left hand first cut about 80 yards ahead and about 35 yard wide of the flag. He hit his ball well left and I felt it brush my hat and then land in a bunker. I looked back and he said " I new it was going to be close but couldn't remember what to shout!!!! My fault for walking in front but we promote ready golf at my club so I guess we all take risks to speed up play.

Sometimes you just can't avoid the risk. We were on a green once, my friend was looking at his ball and considering his putt, when a ball came flying over a low tree, just missed his head (by maybe 4 feet), bounced off the green at a great speed and headed off into the rough like a scalded cat. That ball was really flying.

Turns out it was a badly pushed tee shot from a higher, completely blind tee area. The guy didn't yell fore because he didn't know there was a green there.

Golf has its risks, like other sports. Don't show up if you aren't willing to take them, and look after yourself out there as best you can.

This is why I usually shout fore if my ball is heading anywhere outside my fairway and its immediate bordering areas unless I can clearly see that no one is nearby the landing area. If you can't see where it's going, better to shout than assume that it'll be ok.

In this case, it's not that the guy who hit the ball didn't shout "fore," it's whether he took adequate precautions before swinging when someone was standing in the direction he was hitting. It's not so obvious to me that it's a meritless suit. If I'm as close to someone as is contended in the article, I'm certainly going to be sure they know I'm taking my shot before I swing, just as common sense and common courtesy.

Interesting. Well to me, walking around on a golf course is a "see and avoid" situation, like flying a light aircraft under visual flight rules. Everyone needs to keep a sharp look out to avoid collisions. So it you choose to stand in front of a golfer, within possible strike range, you had better watch carefully and not assume that the shot is going to be well hit.

I used to be a "slip" fielder in cricket (stand a few yards behind the batter waiting for a ball that barely glances off the bat) but have probably lost some of my reaction time. So I tend to be conservative, unless standing in front of TW or certain other professional golfers.

I'm assuming that the plaintiff knew, or should have known, that he was standing perilously close to the defendant.

Don't trust anybody (especially SO CALLED friends)
I use trees, carts, and such to hide behind if I am down range of any shots. H*ll I have seen them go backwards, so 180 degrees is not safe.

Any time another golfer is in front of me, even if they are off to the side, I always yell "heads up" or "coming up" to make sure they see that I am hitting. If they want to stand there and take the risk then so be it. I do have a problem with people who hit behind you when you are not looking and don't know they are swinging. It's maybe more of a courtesy problem than I legal one, but I prefer to have the option to get out of the way.

I knew we were becoming a litigious society, but suing your golf buddy is really low. Well I have always heard that when you go to play golf you accept the risk of being injured by an errant shot from another golfer (that isn't true if the foursome behind you in hitting into your group, the operative word here is errant). But walking ahead of another golfer who has not hit yet would seem, to me, to be increasing that risk significantly. Don't see how this fellow can ever collect and don't see how the case got this far in the legal system. I know lots of folks do it in order to play "ready golf", but saving a few minutes on a round isn't worth the risk in my estimation. Yes the fellow hitting the errant shot should yell Fore or maybe even give the fellow a "heads up I hitting" prior to the shot, but the major responsibility is with the golfer who walks ahead of the fellow hitting.

Yeah, that is true. I'd say if you knowingly get in front of someone who is going to hit, you are assuming 100% of the risk (no matter what the angle).

Agree. I think the key is whether it was knowingly or not. If they're both out searching for their balls, he may not have known that his "friend" had found his ball and was taking his shot.

Don't let my buddy see this - nailed him right in the upper mid back on the approach to 2nd hole of 18; he was about 75 yds in front of me. I yelled fore, but it was too late. If he had turned around, it would've hurt worse. He expletived for a while, shook it off and we continued on.

Another time, I sky'ed a tee shot off the top of my driver head straight up in the air about 50 yards; it drifted in mid-air right about 20 yards over to the preceding green. Couple of guys over there not hit, but also not happy. So yeah, balls can come from anywhere.

Latest news is that New York Courts  rejected the appeal on the suit, ruling what we all know. Golf does have risks.

Very sad though. The one golfer lost an eye and his ability/career as a neurosurgeon as a result. It could have been worse though.
