I believe these to be the most important words in this thread. While I'm always up for free stuff, I would not bet on Sergio Winning. I believe GolfSmith and TM have bet against Sergio in this case.

since TM states that proof of receipt does not mean proof of submission, the class action lawsuit would never get filed as it would not stand a chance...

even so, i feel that the insurance policy that they purchased would cover the loss so they most probably would not do do something that fraudulent... besides, they'd probably want to get the most out of the premium they paid for the policy and it would be in their best interest to provide as many people TM drivers at the insurer's expense since it would be to their advantage to have as many ppl as possible playing TM drivers...

Because the chances are that he probably won't win, especially now that a certain other golfer is "back". So its pretty effective if they get a whole bunch of people to buy the clubs expecting a refund and they don't get one because he doesn't win. Plus its great advertising, I mean look at how many people know about it if it made it on to here. But I haven't read the rules so my opinion may be totally irrelevant.

one small other note to iacas: I may have gotten that wrong but it still reminds me of the Dr. Pepper/GNR controversy. If it happens that Sergio wins Golfsmith or who ever is premoting this will put a cap on it. Its the smart thing to do. I don't know if legal though. Since you're the expert on it, could you please tell me?

For 42 cents and 3 minutes of your time, you'd be insane to not do this. This game is pretty competative and one guy can get hot for a weekend, plus what if Sergio is a real caring fella and digs deep to find the heart to make golfers everywhere happy. I'm sure another company will snatch him right up as soon as TM kicks him to the curb for breaking them ;)

I'd be super pissed if I had bought a TM club in the weeks prior and didn't know about this promo.

I may be naive but, I don't think GS or TM would risk a lawsuit on this if the refused to pay up. I'm sure there are enough rich legal types that would bankroll against them just because they wanted to.

yeah... I was just reading that offer, not sure what I would think either. Maybe TM paid Sergio to throw it, or maybe he's hurt and the TM staff knows about it. Too bad Nike doesn't have the same promotion with Tiger.

Except the putting. That's likely still not where it needs to be.

And the mental strength. That may never be where it needs to be. I've never been a huge "he'll win a major some day" guy, but lately I've swung around to thinking he's more likely to never win a major than to win one.
