What if you had a student who was known to be (and knew herself to be) diabetic and you stood by and allowed her to have lots and lots of sugary drinks - or gave her lots of sweets to her to the point where she went into a diabetic coma when you KNEW she was diabetic? You would bear responsibility.

No. Poor example.

A person who is served alcohol to excess, even if they aren't commonly known to have a drinking problem, but have clearly consumed an excessive amount can easily foresee success in a case against the server when they leave and drive home drunk and get into trouble.

Whether you think it's "BS" or otherwise isn't really relevant.

I’d say that as long as the drinks are correctly stated as having sugar, she’d need to refuse it. If someone lied about it being sugar free or something like that, that’s a different issue of course.

It’s really not everyone else’s responsibility to remember and know your weaknesses. It’s really up to you to determine what you can drink or not.

On top of that, if you’ve drunk alcohol then driving is a no no, right? Is tiger responsible for his stupidity too?

Tiger dropped as a defendant:

Tiger Woods' attorneys announced Monday that the estate of a bartender who crashed his car and died after leaving The Woods Jupiter in December had voluntarily dismissed Woods as a defendant.

They "knew [Immesberger] was suffering from the disease of alcoholism," the lawsuit states, and not only "ignored" that but "fueled it" by letting him drink at the restaurant's bar "to the point of severe intoxication."

Wait, what? “Alcoholism” is categorized as a disease?

That doesn’t seem right? I know many people who are just as addicted to the driving range as some are to alcohol? Should golf courses be sued for excessive shoulder, wrist and other related injuries because they offer large buckets? 🥺

Not terribly surprising.

You generally name any potential person when bringing suit, especially when the got TW's money. Tiger was probably just a bit too far removed from the situation to really be personally responsible. Presumably, his investment in the business is limited and set up to ensure that he isn't personally liable for the restaurant's debts.

Still they probably got a reasonable shot at the business itself and Herman, if she was the one managing it. Again, it's a question of whether there was a duty of care on part of the restaurant and the people running it. The man made a poor decision and he's dead, but should his employer have known enough to not allow him to drink there or at least cut him off well before that point?

The American Medical Association (AMA) declared that alcoholism was an illness in 1956. In 1991, the AMA further endorsed the dual classification of alcoholism by the International Classification of Diseases under both psychiatric and medical sections.

Got it guys...

I might have that propensity too? My great grandfather, grandfather and dad were/are all alcoholics. That it’s at least 50-60% genetic isn’t a good thing. Luckily, my wife doesn’t drink and my kids likely won’t have it?

I don’t, but my brother owns a winery, and my sister overeats...

I do drink Yerba Mate though. Without caffeine, I’m never awake enough 🤪
