"Tiger Woods Suspended for Failed Drug Test" Claims PGA Golfer Dan Olsen

Step 1: Olsen files for freezing the case based on the anti-SLAPP statute (depending on his state).

Step 2: Once the anti-SLAPP is filed for, Woods' counsel can not demand any documents, etc.  Long story short, Olsen doesn't have to spend any additional $ on defending himself or be subject to legal harassment (subpoenas, request for documents, etc).

Step 3: Judge decides, after review, that Woods has no case.

Step 4: Woods is responsible for reimbursing Olsen's anti-SLAPP filing and any legal fees incurred.

Still hope Tiger takes him to court, that'd be hilarious and awesome.

PS I am not a lawyer, this is just how I am told it would probably play out.

That's assuming Tiger has a frivolous case. His case is completely legitimate. Depending on the specific standards of the state he files in, I don't see how Tiger wouldn't at least get to trial on these facts.

For those of us with a less legal background, what is SLAPP and why would Woods become liable when he is the aggrieved party in the first place.

For those of us with a less legal background, what is SLAPP and why would Woods become liable when he is the aggrieved party in the first place.

It's basically a statute that provides mechanisms for defendants to head off frivolous litigation. The concern is a rich plaintiff goes around suing people frivolously who do or say things that plaintiff doesn't like. In this case, we're talking about saying unflattering things that don't rise to the level of defamation. The defendant, who's your average Joe, a guy who can't afford a lawsuit that he'd probably win in the long run, because there'll be high legal fees incurred since the plaintiff would do lots of expensive discovery and motions to make the defendant have to settle, since in America, generally, each party pays their own fees (compare to Britain, where loser pays winner's fees).

So the SLAPP statute, varying by state, basically gives the defendant the right to get the suit dismissed by having an evidentiary hearing early on where the judge decides whether the plaintiff's case has merit. If the judge tosses the case, the plaintiff is responsible for the defendant's costs and maybe a penalty, depending on the specific statute. So it discourages frivolous lawsuits by taking away the threat of "I'll sue you poor because I can afford to."

But, with respect to Tiger, the SLAPP argument assumes Tiger can't prove actual malice by Olsen (that Olsen knowingly said false stuff or did it with reckless disregard for the possibility what he said was wrong). I disagree from what I've read of Olsen's statements. I think he was making crap up to show off on the radio, and I think that fact is at least arguable enough that a judge would let it get to a jury trial.

Oh, and SLAPP just stands for "Strategic Lawsuit Against Public Participation," Google tells me, haha.

Dan Olsen recanted his claim to GolfChannel.com, saying, “My comments were ill advised. I retract the entire interview and apologize to Nike, the PGA Tour, Tiger and Tim Finchem.”

And thus ends the 15 minutes of fame of a blowhard.

But then again, what the hell do I know?

For thoe that think Tiger wering a tight shirt means he used PEDS, THIS is what a guy who uses PEDs looks like - Laron Landry, just suspended by the NFL for PEDs.

Almost an exact match for Tiger, no?  LOL

I have it on good authority that tiger was not suspended but abducted by aliens, which is why he is not playing on tour.

The tourney he pulled out from was nothing by a clone that was used to make us believe that Tiger really has a back issue.

In reality he is in a galaxy far, far away playing for the Universe Ryder cup on the Nebulan team!

Guys, this is getting silly. Anyone who has their tin foil hat on tight enough has received the messages. The real Tiger is working with Elvis to finally prove that the moon landing was faked. I believe JFK and the ghost of Colonel Sanders might be involved as well. When that comes out, the fake chip yips and back problems will all be better.

    • Day 11: did mirror work for a while. Worked on the same stuff. 
    • I'm not sure you're calculating the number of strokes you would need to give correctly. The way I figure it, a 6.9 index golfer playing from tees that are rated 70.8/126 would have a course handicap of 6. A 20-index golfer playing from tees that are rated 64/106 would have a course handicap of 11. Therefore, based on the example above, assuming this is the same golf course and these index & slope numbers are based on the different tees, you should only have to give 5 strokes (or one stroke on the five most difficult holes if match play) not 6. Regardless, I get your point...the average golfer has no understanding of how the system works and trying to explain it to people, who haven't bothered to read the documentation provided by either the USGA or the R&A, is hopeless. In any case, I think the WHS as it currently is, does the best job possible of leveling the playing field and I think most golfers (obviously, based on the back & forth on this thread, not all golfers) at least comprehend that.   
    • Day 115 12-5 Skills work tonight. Mostly just trying to be more aware of the shaft and where it's at. Hit foam golf balls. 
    • Day 25 (5 Dec 25) - total rain day, worked on tempo and distance control.  
    • Yes it's true in a large sample like a tournament a bunch of 20 handicaps shouldn't get 13 strokes more than you. One of them will have a day and win. But two on one, the 7 handicap is going to cover those 13 strokes the vast majority of the time. 20 handicaps are shit players. With super high variance and a very asymmetrical distribution of scores. Yes they shoot 85 every once in a while. But they shoot 110 way more often. A 7 handicap's equivalent is shooting 74 every once in a while but... 86 way more often?
