Police chief of my town is my father in law. Hard not to talk to him, great guy. I actually have gotten really good information from him. But yeah I’ve heard that said before, a couple years ago.

I couldn't help but notice both those gentlemen are good speakers. That was informative and easy to listen to.

That was good info.  Here’s a slightly shorter version of the same thing if anybody was too lazy to watch it all…

Thanks, yeah I'm way too lazy to watch 46 minutes of talk about the 5th amendment and Miranda Rights.  🤣 It always amazes me how many people don't know about this very basic stuff though.

I don't know that it's that they don't know about it.

I think it's that they think "if I didn't do anything wrong I want to be helpful."

Exactly. I used to train the employees at my company about how to respond during an FDA audit. It is very similar approach in that you only need to provide answers to the specific question and nothing else. If you don’t know the answer, say “I don’t know” and that’s it. People want to be helpful, but instead only cause more issues when they speak freely.

In this case with police, you only need to provide identification but are not required by law to say anything else without council regardless of what the investigation is about. Even if they ask you for a witness statement, you can still have council present.

From the main video, my favorite part was when he pointed out the unwritten but obviously inferred part of the Miranda warning that somehow I’d never considered in all my previous 48 years here.

”Anything you say can and will be used AGAINST you …”

… but it will never ever be used FOR you.

It’s so basic and simple but just never thought about it.

Like the cop said; people don’t like silence, and they like to tell their story.

This sure is a varied opinionated topic.    From the original video it seems as if people are too quick to talk and give incriminating information.   I'm a believer that the less shared the better.

Close personal friend is a Defense Attorney with 20+ years experience, and we've had this conversation several times. His advice pretty much aligns completely with the video. We talked one time about what to do if you shoot an intruder in your house:

  1. Call the police
  2. Call him
  3. Shut the hell up

The police are not there to help you, even if you shoot a person wearing a hockey mask and carrying an ax in your living room the only thing you say to the police is, "I would like a lawyer present before I make a statement."

What do you say when you do #1 to get them there?

(I'm not specifically asking about shooting an intruder, but the answer could be modified for a lot of similar situations.)

Great question I just texted him and he said to say this, "There's been a shooting, please send the police". He also said to make sure NOT to say something like, "I just shot someone in my house".

    • I'm not sure you're calculating the number of strokes you would need to give correctly. The way I figure it, a 6.9 index golfer playing from tees that are rated 70.8/126 would have a course handicap of 6. A 20-index golfer playing from tees that are rated 64/106 would have a course handicap of 11. Therefore, based on the example above, assuming this is the same golf course and these index & slope numbers are based on the different tees, you should only have to give 5 strokes (or one stroke on the five most difficult holes if match play) not 6. Regardless, I get your point...the average golfer has no understanding of how the system works and trying to explain it to people, who haven't bothered to read the documentation provided by either the USGA or the R&A, is hopeless. In any case, I think the WHS as it currently is, does the best job possible of leveling the playing field and I think most golfers (obviously, based on the back & forth on this thread, not all golfers) at least comprehend that.

    • Yes it's true in a large sample like a tournament a bunch of 20 handicaps shouldn't get 13 strokes more than you. One of them will have a day and win. But two on one, the 7 handicap is going to cover those 13 strokes the vast majority of the time. 20 handicaps are shit players. With super high variance and a very asymmetrical distribution of scores. Yes they shoot 85 every once in a while. But they shoot 110 way more often. A 7 handicap's equivalent is shooting 74 every once in a while but... 86 way more often?
